- ELIGIBILITY REQUIREMENTS: Open to legal residents of the fifty (50) United States and the District of Columbia who are 18 years of age or older at the time of entry. Employees, contractors, directors and officers of Blue Diamond Growers ("Sponsor"), its parent, subsidiary and affiliated companies, retailers, distributors, licensees, manufacturers, web design, advertising, fulfillment, judging and promotion agencies involved in the administration, development, fulfillment and execution of this Promotion (collectively, "Promotion Parties"), and the immediate family members of each (spouse, parent, child, sibling, grandparent, and spouse of "step" of each) and those living in their same households (those persons whether related or not who live in the same residence for at least three months during the twelve-month period preceding the start date of the Promotion) are not eligible to participate.
- PROMOTION PERIOD: Promotion begins on 9/1/08 at 12:00:00 am Pacific Time ("PT") and ends on 12/12/08 at 11:59:59 pm PT (the "Promotion Period"). Sponsor's time clock is the official clock for this Promotion.
- TO ENTER: There are two (2) methods of entry, online and via phone. Online Entry: To enter online, log on to www.bluediamondfootballnut.com ("Web Site") during the Promotion Period. Follow the on-screen directions to complete and submit the online registration form. For your registration to be valid, you must complete all required information and click on the "Submit" button on the registration page. You will need to obtain a product UPC from the back panel of a Blue Diamond® product, or you may also request a UPC without making a purchase by clicking on the "UPC Code" request link on the Web Site during registration, which will immediately generate a valid UPC for you on your registration form. Once you have registered on the Web Site you need not register again each time you visit the Web Site but you need only enter your e-mail address that you previously registered with when prompted. Once registered, you will be given the opportunity to play the online instant win game and enter the grand prize drawing ("Grand Prize Drawing"). You will be instantly notified whether you have won a weekly tailgating prize pack ("Weekly Tailgating Prize Pack") in the online instant win game (see section five below for the Weekly Tailgating Prize Pack description), subject to verification. Phone Entry: To enter the Promotion via phone, please call 1 (800) 206-6200. Entry via phone does not require online registration. You will be given the opportunity to play the instant win game and enter the Grand Prize Drawing. If you are selected to receive a Weekly Tailgating Prize Pack in the instant win game, you will receive a congratulatory message. When prompted on the phone, potential winners (subject to verification) must clearly state their first and last name and telephone number in order to claim a prize. Failure to do so will result in prize forfeiture. Winners will also receive an entry into the Grand Prize Drawing upon providing this information. If you are not selected to receive a Weekly Tailgating Prize Pack via the phone method of entry, when prompted, you may state your first and last name and telephone number in order to receive an entry into the Grand Prize Drawing. For All Entries (Online and Phone): Automated means of entry are prohibited. All entries have an equal chance of winning. Whether or not you are a Weekly Tailgating Prize Pack winner, you will receive one (1) entry for a chance to win a prize in the Grand Prize Drawing each time you enter the Promotion online or via phone. Limit one (1) entry per person, household, and/or email address online and limit one (1) entry per person, household, and/or phone number per Day of the Promotion Period, for a total of two (2) entries per Day during the Promotion. - GRAND PRIZE DRAWING:
One (1) Grand Prize winner will be selected in a random drawing from all eligible entries received from all entry methods combined. Odds
of winning the Grand Prize depend on the number of eligible entries received. Drawing will be conducted on or about 12/19/08 by Marketing
Resources, Inc., an independent judging organization ("Judges"), whose decisions shall be final and binding on all matters relating to the
Promotion. By participating, entrants agree to abide by and be bound by these Official Rules and the Judges' decisions.
ONE (1) GRAND PRIZE: A check payable to the winner in the amount of $4,000 US. This Promotion is solely sponsored by Blue Diamond Growers and no other entity. - WEEKLY INSTANT WIN GAME:
Winners will be instantly notified upon submitting an entry on the Web Site or calling the toll-free Promotion number whether or
not they have won a Weekly Tailgating Prize Pack. One Weekly Tailgating Prize Pack will be randomly awarded each week of the Promotion
Period (as outlined below). The Judges will determine, at random, the times at which Weekly Tailgating Prize Packs will be awarded throughout
the Promotion Period. The participant that enters the instant win game closest to the time randomly determined by the Judges will be
deemed the Weekly Tailgating Prize Pack Winner (subject to verification). The odds of winning a Weekly Tailgating Prize Pack are based
upon the number of eligible entries received and the time at which they are received. No more than the stated amount of Weekly Tailgating

TOTAL ARV OF ALL PRIZES IN THE PROMOTION IS: $4,750.
- GENERAL CONDITIONS: Winners are solely responsible for any taxes on their respective prizes, and Grand Prize winner will receive an IRS Form 1099 for the ARV of the prize. No cash equivalent or substitution of any prize is offered, except as provided herein and at the sole discretion of the Sponsor. No transfer of prize. By participating, entrants agree to these Official Rules and Sponsor's Privacy Policy (available at www.bluediamondfootballnut.com) which are final and binding in all respects. Unclaimed prizes will not be awarded. Grand Prize winner will be notified by mail and will be required to complete, sign and return an Affidavit of Eligibility/Liability Release, and, where lawful, a Publicity Release within ten (10) days of attempted notification or prize may be forfeited. If an eligible minor wins the Grand Prize, prize will be awarded in the name of his/her parent or legal guardian. If for any reason the Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, Sponsor reserves the right, at its sole discretion, to disqualify any individual who is responsible or who tampers with the entry process, and to cancel, modify or terminate the Promotion. In the event of cancellation, all prizes will be awarded in a random drawing from all entries received as of the time of cancellation. This Promotion is offered only in the United States and is governed by the laws of the state of California, and all claims must be resolved in the federal or state courts of Sacramento County, California.
- LIMITATIONS OF LIABILITY AND RELEASE: All online entrants must have a valid e-mail address. All online entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of initial registration. In the event of a dispute regarding the identity of any potential winner hereunder, the potential winner shall be deemed to be the "authorized account holder" of the e-mail address submitted at the time of entry, provided he/she is eligible according to these Official Rules. The "authorized account holder" is defined as the natural person who is assigned an e-mail address by an Internet access provider, on-line service provider or other organization that is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. All telephone entrants must have a valid telephone number. No more than the advertised number of Weekly Tailgating Prize Packs will be awarded. If because of error (or for any other reason) there are more Weekly Tailgating Prize Pack notifications than prizes offered, a random drawing will be held from among all eligible claimants in such prize category to award only the number of prizes in such prize category as stated in these Official Rules. Sponsor's sole liability for defective instant win game play is to allow one additional game play during the Promotion Period. Sponsor and Promotion Parties are not responsible for errors of any kind, whether human, mechanical or electronic, including without limitation, the incorrect or inaccurate capture of entry information online or via the telephone regardless of cause that may limit a user's ability to participate in the Promotion. Use of Web Site is at user's own risk. Sponsor and the Promotion Parties are not responsible for any personal injury or property damage or losses of any kind that may be sustained to user's or any other person's computer equipment resulting from participation in the Promotion, use of the Web Site or the download of any information from the Web Site. By participating in the Promotion, the entrant thereby releases Sponsor and the Promotion Parties from any and all claims, damages or liabilities arising from or relating to such entrant's participation in the Promotion. By accepting a prize, winner (and winner's parent or legal guardian if a prize winner is considered an eligible minor in his/her state of residency) agrees to release and hold Sponsor and Promotion Parties, and all of their respective officers, directors, employees, representatives and agents harmless from and against, any liability for injuries, losses or damages of any kind to persons or property resulting in whole or in part, directly or indirectly, from participation in the Promotion; from acceptance, possession, misuse or use of a prize; and any liability for taxes, duties or other levies assessed upon any of the prizes.
